HUTTO, November 13, 2025 – The Texas Solicitor General has filed a brief with the Texas Supreme Court supporting the City of Hutto’s position in an ongoing case involving Public Improvement District (PID) bonds issued for the Co-Op District.
The case stems from a 2018 bond issuance approved under previous City leadership and legal counsel. The $17.4 million in PID bonds funded infrastructure improvements for the Co-Op District, with repayment structured through assessments on property owners and a portion of redirected ad valorem taxes. However, a 2020 audit raised concerns that the previous city attorneys did not submit the bonds for state review, which led the City to seek legal clarity through the courts.
The Solicitor General’s brief, filed on November 7, states that if the bond documents had been submitted to the Texas Attorney General as required by State law, the Attorney General’s office would have disapproved the bond to prevent its issuance. This opinion not only supports the City’s legal arguments but also strengthens the case as it moves toward a final decision from the Texas Supreme Court.
“I am grateful the Solicitor General filed a brief in support of River Creek's claims in this lawsuit,” said Peter Gordon, chair of the River Creek LGC. “The crux of this issue is whether the loan had to be reviewed by the Texas Attorney General, and whether the bond issuance costs could be included in the overall PID assessments issued for the project. We do not seek to avoid our financial obligations; our intent is to ensure that everything we do fully complies with Texas law. I look forward to a final decision by the Texas Supreme Court to put these important questions to rest.”
The Supreme Court has not yet announced whether it will hear oral arguments. However, with all briefs submitted and no further procedural steps remaining, a decision could be issued at any time.
